Agreement to Terms
By accessing or using the services of SMM Salem Masonry, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and others who access or use our services.
Services Description
SMM Salem Masonry provides masonry contractor services including but not limited to brick repair, chimney services, tuckpointing, retaining wall construction, stone patio installation, and related masonry work. All services are provided according to industry standards and local building codes in Salem, OR and surrounding areas.
Specific details of services, timelines, materials, and pricing will be provided in written estimates and contracts for each individual project. We reserve the right to refuse service to anyone for any reason at any time.
Estimates and Pricing
All estimates provided by SMM Salem Masonry are good faith approximations based on site inspections and project scope at the time of the estimate. Final pricing may vary if conditions change or additional work is discovered during the project. Any changes to the original estimate will be discussed with the client before proceeding.
Estimates are valid for 30 days from the date provided. After 30 days, material costs and availability may change, and a new estimate may be required. Payment terms will be outlined in the project contract and may include deposit requirements and milestone payments.
Project Timelines
We make every effort to complete projects within the estimated timeline provided in your contract. However, timelines may be affected by weather conditions, material availability, unexpected site conditions, or other factors beyond our control. We will communicate any delays as soon as we become aware of them.
Clients are responsible for providing clear access to work areas and ensuring that utilities and property conditions are safe for our crew to work. Delays caused by lack of access or unsafe conditions may extend project timelines.
Warranties and Guarantees
SMM Salem Masonry stands behind the quality of our work. We offer warranties on craftsmanship as outlined in individual project contracts. Warranty coverage typically includes defects in workmanship but does not cover damage caused by natural disasters, improper maintenance, or modifications made by others.
Material warranties are provided by manufacturers and will be passed along to clients when applicable. We use quality materials from reputable suppliers and will provide manufacturer warranty information upon request.
Liability and Insurance
SMM Salem Masonry is fully licensed, bonded, and insured to perform masonry work in Oregon. We carry general liability insurance and workers compensation insurance to protect both our clients and our team. Proof of insurance can be provided upon request.
While we take every precaution to protect your property during work, we are not responsible for pre-existing conditions, hidden defects, or damage to underground utilities not marked by the appropriate utility companies. Clients are responsible for having all utilities located before work begins.
Cancellation Policy
If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may forfeit any deposits paid. This covers our costs for materials ordered and scheduling commitments made.
For projects already in progress, cancellation terms will be outlined in your contract and will typically include payment for work completed to date plus materials purchased.
Intellectual Property
All content on the SMM Salem Masonry website, including text, images, logos, and design elements, is the property of SMM Salem Masonry and is protected by copyright laws. You may not reproduce, distribute, or use any content from our website without written permission.
We may photograph completed projects for marketing and promotional purposes. If you prefer that your property not be photographed or used in marketing materials, please inform us in writing before the project begins.
Dispute Resolution
We strive to maintain positive relationships with all our clients. If any disputes arise regarding our services, we encourage open communication to resolve issues quickly and fairly. Most concerns can be addressed through direct discussion.
If a dispute cannot be resolved through discussion, both parties agree to attempt mediation before pursuing legal action. Any legal proceedings will be conducted in Marion County, Oregon, and will be governed by Oregon state law.
Changes to Terms
SMM Salem Masonry reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
We recommend reviewing these terms periodically to stay informed of any updates. The date of the most recent revision will always be displayed at the top of this page.
